1. Introduction
Events organised by Brenchley and Matfield PTFA are run by volunteers. Whist all reasonable effort is made to ensure that your expectations are met, there may be occasions when not everything is perfect. Was ask that rather than criticise or complain you volunteer to help us improve.
2. Cancelations
If any event, or part thereof, is delayed or cancelled due to unanticipated circumstances or circumstances beyond our control, including but not limited to weather conditions, refunds cannot be provided.
3. Risks
There are numerous risks at our events including uneven ground, unfavourable weather and even fireworks! Suitable clothing and footwear should be worn at all times. Supervision of children and others with any additional needs remains the sole responsibility of the accompanying adult at all times.
All rules, warnings, instructions and fences/barriers must be respected at all times.
All adults on site have joint responsibility for their own safety and the safety of others. If you notice any dangers or unacceptable risks you should report them immediately to the event organiser.
4. Liability
Some events may involve inherently dangerous activities. Neither Brenchley and Matfield PTFA, its members, volunteers or Trustees shall be liable for any damage, loss, delay or expenses caused to any visitor, member, agent, licensee or invitee or any other persons attending the event except insofar as it results from the negligence of the PTFA’s Trustees
5. Force Majeure
The PTFA and its Trustees shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lockouts, accidents, war, fire, breakdown of plant or machinery.
6. Severance
If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be modified, with minimal change to its meaning, to make it valid and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid, illegal or unenforceable provision so modified.
7. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the law of England and the parties hereby submit to the exclusive jurisdiction of the English courts.
